User Agreement

Important Notice: Think Academy International Education Limited, hereby reminds users to carefully read and fully understand the terms of the "User Agreement" (hereinafter referred to as "Agreement"), including Exemption or Disclaimer of service liability and Restrictions on User rights. Please review and accept or reject this Agreement. Unless you accept the terms of this Agreement, you are not authorized to use the product and its related services.

This Agreement is a legal agreement between users (hereinafter referred to as "Users") and Think Academy. This Agreement describes the rights and obligations between Think Academy and the user regarding the use of the website and related issues.

1. Statement of Rights

This website is independently developed and provided with operational management services by Think Academy. All intellectual property rights, and all information related to the website, including but not limited to: textual expressions and combinations, icons, graphics, images, diagrams, colors, interface design, layout frameworks, related data, additional programs, printed materials or electronic documents are all owned by Think Academy, protected by Copyright law, international copyright treaties and other intellectual property laws and regulations.

2. Scope of Use
After opening the link and registering in Think Academy’s designated official channel, the User can use the basic functions of the website.
The User shall provide relevant personal information when acknowledges and agrees to register as a User of the website. Think Academy is completely exempt from liability if you are not able to use the relevant functions of the website due to your refusal to provide the foregoing information. If the personal information changes, you are entitled to contact Think Academy and request modification of the relevant personal information. You are entitled to contact Think Academy at any time to request deletion of all personal information related to you (Before you request the foregoing removal with Think Academy, Think Academy’s right to use the relevant personal information within the scope of this Agreement is not subject to the above limitation).
The User should select version of the website that matches the User's computer, system, etc. Otherwise the website and services may not be available.
In order to use the website in the actual computer operation environment or to improve its functions and performance, the User may make necessary modifications. However, unless otherwise agreed in the contract, the modified website may not be provided to any third party without the permission of Think Academy.
3. Restrictions of Rights
Prohibition of Reverse engineering, Decompilation and Deassemble:

The User shall not Reverse Engineer, Decompile or Disassemble the website, and shall not modify any resource compiled inside the program file. In addition to laws and regulations expressly permitting the activities above, the User must comply with the limitations of this Agreement.

Component Segmentation: Each website in the website product is licensed for usage as a single product and shall not be used separately by the User for any purpose.
Individual Use: For commercial sales, reproduction, distribution, including but not limited to website sales, pre-installation, bundling, etc., the User must obtain written permission from Think Academy.
Reserved Rights: All other rights not expressly stated in this Agreement are still owned by Think Academy. Users must obtain written consent from Think Academy when exercising other rights.
Except as expressly provided in this Agreement, this Agreement does not stipulate relevant terms of service for other services of the company by using the website. For those services, there might be separate terms of service. Users should acknowledge and confirm separately when using those service. If the User uses the service, it is deemed as an acceptance of the relevant terms of service.
4. Your Responsibilities
Website Functions

4.1.1 This website’s function includes but is not limited to: account registration, sign-in, account setting, news releasing, resource downloading, activity sign-up, course enrollment, fee payment.

4.1.2 Users acknowledge and agree that the data generated during the process of using website related functions might be necessarily processed and stored by cloud service. The User is fully responsible for the content posted, uploaded or transmitted by himself. All Users are not allowed to post, reprint or transmit information that contains one of the following contents during the use of the website. Otherwise, Think Academy has the right to dispose of it without notifying the User:

  • 1) Invasion of privacy;
  • 2) Infringement of intellectual property rights;
  • 3) Harassment, threats, insults or defamation of others, infringement of the legitimate rights and interests of others;
  • 4) Harm to children's safety;
  • 5) Content containing violations of the principles of integrity and authenticity, including spam, untrue information and false information;
  • 6) Content containing harmful or dangerous matter, including spreading obscenity, pornography, violence, murder, terrorism or abetment, and hatred;
  • 7) Other content prohibited by laws and administrative regulations.
In order to allow Users to easily use the website, corresponding documents are included in the website. In order to update the website information in time, the website provides online upgrade function.
The website is supported by product development technology from Think Academy.
Modifications and upgrades of the website: The intellectual property owner of the website reserves the right to provide the User with modified or upgraded version of the website at any time.
Users should use the website under the premise of complying with the law and this Agreement. Users are not authorized to take the following actions, including but not limited to:

4.4.1 Delete or change all copyright information and content in the website and other copies;

4.4.2 Deliberately avoid or destroy the technical measures taken by the copyright owner to protect the copyright of the website;

4.4.3 Mislead or deceive others by using the website;

4.4.4 Violate national regulations by deleting, modifying, increasing, and interfering with the computer information system functions and resulting in the disfunction of the computer information system;

4.4.5 Enter computer information network or use computer information network resources without permission;

4.4.6 Delete, modify or add computer information network functions without permission;

4.4.7 In regards to related information of the website, without written consent of Think Academy, take the following actions including but not limited to, use, lease, lend, copy, modify, link, reprint, compile, pose, publish, create mirror sites, unauthorized use of the website to develop derivative products, works, services, packages, plug-ins, compatibility, interconnection, etc.;

4.4.8 Destroy normal operation of the website system or the website and intentionally disseminate destructive procedures such as computer viruses;

4.4.9 Use the website to transmit or distribute, in other ways, to transmit documents containing images, photographs, website or other materials protected by intellectual property laws, for example (not exclusively listed): copyrights, trademarks, portraiture right, privacy or publicity, etc., unless the User owns or controls the corresponding rights or has obtained the necessary recognition from the intellectual property owner of the website;

4.4.10 Use the website and other services provided by Think Academy in any unlawful manner, for any illegal purpose, or in any manner that is inconsistent with this Agreement;

4.4.11 If the User violates the requirements above, Think Academy has the right to terminate, completely or partially suspend, and limit the usage of the website.

Think Academy is unable to guarantee whether the website is infected with computer viruses, whether there are hidden Trojan Horse programs or hacking website. Using such website may cause unpredictable risks. Users are advised not to download, install or use them easily. Think Academy is hold harmless from all legal liabilities and disputes arising from such activity.
Users acknowledge and agree that if they decide to use certain functions, then in order to implement the function, Think Academy may upload some or all data information generated by the User during the use of the website, save to the third party cloud service storage, and retrieve relevant data information according to the function command requested by the User. If Think Academy is unable to provide website services due to dysfunction such as third-party cloud service interruption, Think Academy shall be responsible for coordination and try to avoid affecting Users' normal use.
Users acknowledge and agree that when they use the website, the website may invoke other Think Academy website, third party systems or third party website functions to support Users’ use or access., There may be mutual calling functions, links to third-party resources, and data sharing with your consent between the website and other Think Academy website or other third-party website. At the same time, if the User decides to use certain functions, then in order to implement these functions, the User is required to open a computer-related auxiliary device (such as microphone, camera, etc.) or agree to call the computer local data file. If the User refuses to open the auxiliary device or call the local data, part of the website function might not be realized. If the related User information is maliciously exploited, stolen or even deleted by other third parties due to User’s execution of the instructions above, Think Academy shall exert efforts to take necessary measures to protect the legitimate rights and interests of the User from infringement.
If a service is provided by a third party, the User shall also abide by the third party's user agreement in addition to complying with the Agreement. The results of the use or access are provided by the third party (including but not limited to the services and content provided by the third party to which the User is redirected through the website), and Think Academy is unable to guarantee the security, accuracy, validity and other uncertain risks of the services and content provided by the third party. Users should bear those relevant responsibilities themselves.

6.Disclaimer and Limitation of Liability
The website does not contain any malicious code designed to disrupt computer data and obtain privacy information of the User. This website has been thoroughly tested, but it is not guaranteed to be fully compatible with all website and hardware systems. There is no guarantee that the website will be completely error-free. In the event of incompatibility and website errors, Users can call the technical support number to report the situation for technical support. If the compatibility issue cannot be resolved, Users can delete the website.
To the fullest extent permitted by applicable law, damages and risks arising out of the usage or inability to use the website, including but not limited to direct or indirect personal damages, loss of commercial profit, trade disruption, loss of business information or any other economic loss, Think Academy does not bear any responsibility.
Think Academy is not responsible for any damages caused by telecommunication systems or Internet network failures, computer malfunctions or viruses, information corruption or loss, computer system problems or any other force majeure.
For Users who violate the provisions of this Agreement and cause damages to Think Academy, Think Academy has the right to take measures including, but not limited to, discontinuing the use of licenses, cessation of service, restrictions on use and legal actions.
7.Governing Law and Dispute Resolution
This Agreement applies the laws of the United Kingdom.
Any dispute arising from or in connection with this Agreement shall be settled through amicable negotiation; Otherwise, either party may submit the dispute to the court where Think Academy is located.
If any provision of this Agreement is wholly or partially invalid or unenforceable for any reason, or is in violation of any applicable law, the provision is deemed to be deleted, but the remainder of this Agreement will continue to be valid and binding.
If any provision of this Agreement conflicts with the terms of the End User License Agreement for a particular website in the website, the terms of the End User License Agreement for that particular website shall prevail.
Think Academy has the right to modify this Agreement at any time in accordance with changes of laws and regulations, as well as adjustments to the company's operating conditions and business strategies. The revised agreement will be published on the designated website of Think Academy and will be attached to the new version of the website. In the event of any relevant dispute, the latest agreement shall prevail. If the User does not agree with the changes, the User can delete the website. If the User continues to use the website, the User is deemed to have accepted the changes in this Agreement.

At this point, the User has read and understood this agreement in detail and agrees to strictly abide by the terms and conditions herein.
